Course Description

The IRS remains laser-focused on taxpayers and their foreign reporting obligations, including FBARs under Title 31. Taxpayers who have failed to file one or more FBARs may be subject to draconian civil penalties and, in worse cases, criminal prosecution. However, in certain instances, taxpayers may be able to take advantage of various IRS programs that permit taxpayers to regain compliance with their FBAR reporting obligations with reduced civil and criminal exposure. This course will provide tax professionals with an overview of the FBAR reporting regime and potential defenses to the imposition of civil and criminal penalties associated with a taxpayer’s failure to file FBARs.

Learning Objectives:

  • Define the FBAR reporting regime, including the requirements to file FBARs

  • Recognize the potential penalties associated with the failure to file FBARs

  • Identify the various IRS programs that may mitigate or reduce penalty exposure and risks
